Terms and Conditions
1: If a customer decides to book a walk with Walk South Wales and Walk South Wales agrees to take that booking, the customer is entering into a contract with Walk South Wales.
2: Customers are warned that all of the activities organised by Walk South Wales require the exertion of strenuous exercise in order for customers to participate. Customers should therefore be of reasonable fitness before attempting to take part, if you are in doubt please seek professional medical advice. By confirming the booking with Walk South Wales the customer is acknowledging this fact and agreeing that he/she and each other person for whom he/she organises a walk, has the requisite level of fitness.
3: All bookings are non-refundable and non-transferable.
4: Customers who are organising a walk for other people to attend, whether or not the customer will be attending the walk themselves, warrant to ensure that all of the people for whom they book a walk or are provided with a copy of these Terms and Conditions and any other documentation or notices with which Walk South Wales provides the organiser. Walk South Wales reserves the rights afforded to it under these Terms and Conditions to refuse to allow any person booked to participate in a walk, notwithstanding the fact that that person may not have been given any of Walk South Wales notices or information by the organising customer.
5: Provisional bookings or enquiries are not to be interpreted as forming a contract between the parties. A contract shall only be formed between the parties once a Confirmation has been sent to the customer by Walk South Wales.
6: Reservations can be made through the website of Walk South Wales. Valid credit or debit card details for the cost of the walk must be supplied to Walk South Wales at the time of booking. Payment in full must be made at the time of booking. Upon receipt of full payment, reservations will be confirmed by Walk South Wales by e-mail, which will constitute confirmation of reservation.
7: The receipt of full payment is deemed to be confirmation to Walk South Wales that you have read, understood and accepted these Terms and Conditions as the terms on which a contract between the parties shall be governed.
8: The price paid to Walk South Wales shall exclude personal insurance, entrance fees, gratuities and any other item not specifically mentioned as being included.
9: The arrangements for the walk that Walk South Wales will host will be detailed in the Booking Form. Once Walk South Wales have accepted the booking by way of the Confirmation, the specific details will be sent to the organising customer in the confirmation email. Walk South Wales will use its best endeavours to ensure that the booked walk is as close in specification to the walk as it appears on the Walk South Wales website. The walk provided will be lead/supervised by a suitably qualified guide.
10: Confirmed walks can be cancelled for a full refund providing at least 48 hours notice is given. Cancellation requests must be made in writing by emailing email@example.com or using the enquiries form on the Walk South Wales website. Refunds will be processed by BACs within 48 hours of receiving the request.
11: Walk South Wales reserves the right to vary walks from the specification set out on their website or to cancel walks at its own discretion. In the unlikely circumstance that a walk is cancelled by Walk South Wales, the customer will be informed immediately where upon he/she will be offered an alternative date for a walk of similar value and specification. In the circumstance that the parties are unable to reschedule the walk to both of their satisfactions within one month of cancelling the event, the customer will be offered a full refund of all sums paid to Walk South Wales.
12: All members of the party must comply with safety regulations and instructions of Walk South Wales staff. Should a guide find that a member(s) is being disruptive or jeopardising the safety and enjoyment of others then Walk South Wales reserves the right to either ask that person to leave the walk, in which case that person will not be refunded any of the sums paid to Walk South Wales, or to cancel the event without refunding any of the monies paid to Walk South Wales.
13: All customers taking part in walks will be polite and courteous to others, act sensibly and prudently and respect the countryside at all times. Walk South Wales reserves the right to deny any person who does not abide with this, or any other term or condition, before or during the walk, from taking part in the walk without refunding that person any monies.
14: Walk South Wales will allow dogs to accompany customers on its walks. This provision includes guide dogs for the blind.
15: All persons under the age of 16 who take part in a walk offered by Walk South Wales must be accompanied by a parent or Guardian.
16: Notification of the equipment required by all customers in order for them to take part in a walk may be found on the booking confirmation email which will be sent to the email address provided once a booking is paid in full. Walk South Wales reserves the right to refuse to allow any person without the appropriate equipment to take part in the walk or event at any time without refunding the customer or any member of the party.
17: Walk South Wales takes no responsibility and will not be held responsible for death, personal injuries, accidents or loss or damage to property or belongings that occur to a customer, or any person attending a walk (except in the case where death or personal injury are caused as a result of the negligence of Walk South Wales). Further, Walk South Wales will not be liable for any consequential or indirect loss resulting from the cancellation of a walk, from that set out in the specification on the Walk South Wales website or its booking confirmation email.
18: In the event that a customer is an organiser of a walk for others to attend, the customer indemnifies Walk South Wales from any claims whatsoever for any loss or damage arising from any omission on the part of the organising customer to pass on any notices or documentation from Walk South Wales to the person who participates or intended participant in the walk or event.
19: In booking and attending a Walk South Wales walk, a customer or participating person understands and agrees that he/she is participating in the Walk South Wales activity at his/her own risk.
20: Walk South Wales has a Public Liability Insurance Policy. However, Walk South Wales advises customers to take out insurance to cover death, personal injury, loss or damage to personal property / belongings and to cover the costs of cancelled or varied walks.
21: The information given in Walk South Wales website and by its Representatives has been carefully checked and Walk South Wales believes that it is correct at the time of publication. Walk South Wales reserves the right to make changes to these publications and representations at any time.
23: If you leave an event part way through and you and the guide are happy with the action, then the guides duty of care over you ends there.
24: Walk South Wales responsibility for you on the event begins at the designated pick up point.
25: Should an event be cancelled or not take place, for whatever reason, you will receive a full refund for the walk fee. We will always seek a viable alternative if possible. We will not be held responsible for other losses (accommodation, fuel costs, food etc) occurred to the cancellation of the event. Again, for this reason we recommend you take out cancellation and curtailment insurance.
26: Unless specified seating will be on a "first come, first serve basis".
27: To comply with legislation and for the safety and comfort of our passengers the consumption of hot food, use of alcohol, tobacco and non-prescribed drug products is strictly prohibited on our vehicles at all times
28: Walk South Wales will not accept responsibility for last minute alterations or cancellations due to weather conditions (an alternative tour date will be offered or cancellation in accordance with the cancellation clause by Walk South Wales as set out above). Walk South Wales will not accept responsibility for delays or otherwise due to traffic and/or road conditions or other related circumstances beyond our control. In the event of such occurrence, no compensation, consequential losses or other such claim will be entertained.
29: Walk South Wales will not accept responsibility for last minute cancellation, delays or any other related circumstances due to vehicle breakdown or immobilisation. In the event of such occurrence, no compensation, consequential loss or other such claim will be accepted. Should such occurrence take place after departure, Walk South Wales will be responsible for returning passengers to point of inception of their journey with Walk South Wales.
30: Walk South Wales shall not accept responsibility for your overall enjoyment. Whilst all effort is made to maximise your experience, it is universally accepted that each person’s preferences and tastes are unique and therefore an impossible task to satisfy all our customers all of the time. Walk South Wales accept that its own success is dependent on word of mouth recommendations and customer satisfaction.
The content of the Walk South Wales website is protected by copyright, trade marks and other intellectual property rights. Customers may retrieve and display the content of the Walk South Wales website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided customers keep intact all and any copyright and proprietary notices. Customers may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Walk South Wales website without written permission from Walk South Wales.
These Terms and Conditions will be subject to the laws of England and Wales and the English courts will have jurisdiction in respect of any dispute arising from the contract.
Should a customer have any complaints about any element of the walk then he/she should make these known to the guide at the time. Alternatively, customers may write to Walk South Wales who will use its best endeavours to resolve the problem straight away.
If a customer breaches these Terms and Conditions and Walk South Wales chooses to ignore this, Walk South Wales will still be entitled to use its rights and remedies at a later date or in any other situation where any customer breaches the Terms and Conditions.
Walk South Wales shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
